Geico、Google と Overture を提訴 - 商標権問題

米CNET によると、自動車保険会社 Geico が検索連動型広告において同社が保有するキーワードの販売により商標権を侵害しているとして、米Google 及び 米Overture Services Inc. をバージニア州アレクサンドリアの連邦裁判所に提訴したことが明らかになった。

Geico は Warren Buffett氏が所有する投資会社 Berkshire Hathaway の子会社。Google および Overture は Geico が商用登録しているキーワードをライバル企業に販売して広告を表示させている。これは消費者の混乱を招くことになり商標登録及び保護を定めた Lanham Act に違反するとしている。

Geico は、我々が莫大な資金を投じて作り上げたブランドが（彼らの慣行により）違法に搾取されることにつながると非難している。

なお、キーワードの商標権問題を巡っては Google が提訴されていたが今回は Overture も含まれている。

商標登録された言葉の取り扱いについて、Overture は次のようなガイドラインを設けている。

In cases in which an advertiser has bid on a term that may be the trademark of another, Overture allows the bids only if the advertiser presents content on its Web site that (a) refers to the trademark or its owner or related product in a permissible nominative manner without creating a likelihood of consumer confusion (for example, comparative advertising, sale of a product bearing the trademark, or commentary, criticism or other permissible information about the trademark owner or its product) or (b) uses the term in a generic or merely descriptive manner. Overture は広告掲載前に審査のステップを設けており、上記ガイドラインに照らし合わせて判断をしているはず。
